So, Mason has won his case against Giants and been awarded £160,00+ in damages. What does anyone make of this? Does he deserve the compensation or has there been a miscarriage of justice?

Jeez that's incredible,I've followed this story,he doesn't deserve a penny.

IF we have followed the correct procedures in terms of his disciplinary how the hell does all the tosh about what we did in terms of other players have any relevance.

Flabbergasted.

It will be interesting to see what sort of reception Mason receives on Sunday. Hopefully it will be very hostile.

Dear o deary me, If you want rid of a player there are ways to go about it. The judge saw through this shambles in no time at all, Don't know about on the field but there are certainly some stars off it at the Giants.

I have to say i didn't see the picture , The Examiner described it as a cheeky photo, The judge saw it as an attempt to get rid of an unwanted player, that some rugby genious had given a 4 year contract too. Also if you had posted the picture would you have expected to be sacked from your job, And why does Calzaghe ( a man who has got to the very top of his sport) become an Idiot because he is a mate of Mason.
"A fool and his money are soon parted" I think you would need to talk to Mr Davy about that, some of his employees seem to be getting rid of his for him.

Whether you like Mason or not, he was quite clearly unfairly dismissed. The club are to blame. There was only ever going to be one outcome. How the hell did Spewlis think he'd get away with a trumped-up charge like this? Thank God for Employment Law. Workers shouldn't be treated this way.

Very poor.

It just gets better and better. What a shambles, It seems the men behind the decisions are no better at getting rid of players than they are at keeping the good ones, They must have been desperate to try that on, Good on Mason for standing up for himself, Even if he had of posted it , it was never a sacking issue, The Giants have just made themselves look stupid. To try and justify it with a load of guff about morals is quite funny. It's 2013 not 1913.
I am a big admirer of KD but deary me he wants to be having a serious look at some of his Lieutenants,

Nail on head.

The "morals" stuff is frankly tripe. Talk about hypocritical.

I too really do like Davy but I've always thought that his Achilles Heel is his choice of deputies. I've said for a while now that with a competent boardroom the Giants would be a trophy-winning side now. However, they are clearly not up to it. It seems to be a real blind spot for Davy, his choice of Seconds In Command.

Gives me no satisfaction at all to be proved right.

Agree, Mason got what he deserved, £ 167k compensation. The statement on the club website is frankly an embarrassment, remember the club condones the annual "naked run", where is the upholding of public morals there? Darryl Griffen was convicted of assault and not sacked, where were the morals then?

It was well reported that Luke Odonnell and Mason were big mates, did this have any bearing on LOD's sudden urge to return to Oz? By heck we could have used KM and LOD's aggression last Sunday.

A player has been proven in court to have been treated shamefully, that is going to make signings more difficult, given equal offers would you join the an employer with a record of staff mistreatment.

Why does the clubs moral fibre not demand an investigation into proven staff mistreatment.

Ken Davy has been great for the club, but he has allowed his team to get this badly wrong imo

PostSubject: Re: Keith Mason   Fri Jul 19, 2013 9:48 am

My view
I am sure no Giants fans are taking pleasure in it.

MY view is that i am pleased that an employee who was treated disgracefully by an employer has been vindicated. I would feel like this whether it was a bus driver, a school teacher or a rugby player. Employees need rights no matter who they are. I do not subscribe to the view of my club right or wrong. There are things to me that are more important and workers rights is one of them

But there are significant issues here which the club need to address. Ken Davy's statement was an embarrassment and in my mind raises concerns about whether he is out of touch with the day to day management of what is going on. If he is he needs to know that a lot of fans feel that this thing has been a PR disaster and a financial disaster for the club.

Who will Ken turn to to find out what has gone wrong and who was responsible. My guess is it would be Thewlis and Morgan who are his main Lieutenants yet thye are the people who seem to be to blame.

On the basis of the evidence (and i have successfully run 8 Unfair dismissal claims on behalf of friends and colleagues) the decision to defend this claim seems absolutely ludicrous. Whose decision was it to fight the case. Additionally employers often settle out of court to avoid damaging publicity.

The club must have known ( But did Ken?) that they had given misleading information to the RFL (LIED) and that this would come out in a hearing. Did Thewlis tell the legal advisors that this was an issue or was it kept on the QT?

The consequence of this is that the club have lost HUNDREDS of THOUSANDS of pounds. anywhere between half and three quarters of a million pounds

Will Ken cover this himself or will it come from selling players and not recruiting others. If it is the second of those options the club and us fans will suffer. Did we lose LOD and EDEN to pay for it.

Has Ken being let down by his managers ?

Finally can any SL Club say, with absolute honesty, that they have never made an approach to a target player that did not, in any way, infringe the restrictions imposed by the RFL

as for this point i agree and i guess that most clubs do lots of other dodgy stuff BUT the point is you DO NOT GET CAUGHT.

Defending this claim was a guarantee that the club got caught out.

A huge mistake was made in sacking Mason the way it happened, that is bad enough but to compound it with all the other mistakes was incompetence of the highest order.

I do not expect or feel that as fans we are entitled to know the inner workings of the club or management issues that is internal stuff for the club BUT i do feel that IMHO Ken deserves better than he has been served by some of his key staff at the current time.

and as for the trolls from other clubs being given ammunition that is not the fault of posters on here is is the fault of the incompetence of Giants officials to let this happen.

Well put DG, This has been a complete shambles , Is it any wonder the club don't go forward, I've not forgot the way Gary Scofield was treated yet. We obviously have some star performers running things. It's a bit like when they tell us we have to pay top Bankers big money to keep them , when we know no body else would have em, they are that bad.
I suppose when you are backed into a corner like KD was you have to say something, and it looks as though he opted to try and back up his staff, IMO an apology to everyone would have been a better idea.

Disgraceful decision from this so called judge.

We'll never know all the information for this case, but you would hope that the judge was fair, employers have no right to push employees around and employees should do their jobs properly. Some employers do push their employees around and some employees take the mick. Where this lies I don't know. Players have got away with worse, it would seem his naughty behaviour gave the club opportunity. Or maybe it was the final nail after a list of other issues. If it had been Eorl and not Keith, would he be sacked?

You are right Matt, we won't ever know the whole truth, you are also right IMO that the club saw this as an opportunity to get rid of Mason, more importantly so did the judge.
As i read it Mason wasn't even the one who posted it but the club were going to use it anyway, On top of all that they turn a blind eye to Mad Monday and naked runs and all the rest of end of season stuff, and then try to play the Morals card,
I have always had a great deal of respect for K Davy, i still have ,but i am very disappointed with this, I have a feeling he has done his best to back someone up who doesn't deserve it.

And it gets better yet, The RFL may reopen the Kopczak affair. Just imagine being investigated by just about the most incompetent bunch of people ever to be put in charge of anything (just MO of course)
Whatever the problems at the Giants, They pale in comparison to the one's at the RFL, It seems to be run on a similar basis to the Mad hatters tea party. We could soon be back to what we had for 80 years , 1 big league of all clubs and Yorks/Lancs Cups.

Shambles - whoever thought the club could get away with this is a fool and i dont want them involved in my club, they have made a colossal error here and there is not a court in the land i dont think that would have backed the club - it was pretty obvious from reading what we could that we were guilty.

After this saga the conclusion I am reaching is that if you have got enough money, spare time, have the right connections then you will get away with misconduct.

Recently there was an article in the examiner where a local guy got fired after comments he put on his private facebook, that moralists complained about, whereas this judge in the mason case was at pains to point out - the player’s Twitter account was personal and was not “inextricably linked” to the Huddersfield Giants and 'The offensive tweet took place outside of the workplace'

I personally know a lad who got fired from a local company for using one particular word on facebook.

I have been made aware it's disciplinary if derogatory words appear on social media.

For me it's a dangerous precedent set by this judge, now these law unto themselves types will push the boundaries of acceptable behaviour even further

Well done to Sir Ken for coming out with the statement that he did, saying despite this he will in future continue to attempt to uphold the good name of the club.
